Ramsco Car Rental – Terms of Agreement

This policy outlines the terms under which Ramsco Car Rental (“we,” “our,” or “the Company”) provides rental services to our clients (“the Client” or “the Renter”). By reserving or renting a vehicle from Ramsco Car Rental, you acknowledge and agree to the full terms and conditions herein. These policies are in accordance with commercial and civil laws in the Kingdom of Morocco governing rental agreements and consumer rights.


1. Payment Policy

1.1 Upfront Down Payment (Advance in Cash)

  • All rentals require an upfront cash deposit equal to 25% of the total rental fee.

    • This acts as a non-refundable down payment and will be deducted from the overall rental amount.

    • This deposit confirms the booking and protects Ramsco Car from potential non-payment.

1.2 Full Payment Method & Damage Coverage via Cheque

  • The remaining 75% of the rental balance must be paid via a certified bank cheque prior to vehicle delivery.

  • An additional security cheque is required in the amount of 3 times the rental fee, held as a guarantee against damages, violations, late returns, abandonment, fuel discrepancies, or breach of policy.

Example:
For a 1,000 MAD rental:

  • 250 MAD is paid in cash.

  • 750 MAD is paid via cheque.

  • An additional 3,000 MAD cheque is held as a refundable security.

  • If the vehicle is returned in good condition, clean, on time, and with a full fuel tank, we will return the security cheque minus any applicable deductions.

  • This cheque is not cashed unless there is a violation of the rental agreement.

  • This is a general example not applicable to all vehicle’s as we price each car differently

1.3 Cheque Policy & Verification

  • We do not accept personal cheques that cannot be verified through a Moroccan banking institution.

  • Ramsco Car reserves the right to refuse any payment method that appears fraudulent or non-verifiable.

  • The Renter acknowledges that issuing a dishonoured cheque in Morocco is a criminal offense under Moroccan Penal Code Article 543, and legal action will be taken in such cases.


2. Refund Policy

2.1 Rental Fee

  • Rental payments are non-refundable under all circumstances, including:

    • Early return of the vehicle.

    • Cancellation after booking.

    • Discontent related to driving experience or external conditions.

    • No-shows or late pickups.

2.2 Security Deposit Cheque

  • The security deposit (cheque) is refundable only if the following conditions are met:

    • Vehicle is returned on time and to the agreed location.

    • Vehicle is returned clean and with a full tank of fuel.

    • No damage, mechanical issues, excessive wear, or fines occurred during the rental period.

    • No breach of any term in this agreement.


3. Vehicle Condition & Return Terms

3.1 Cleanliness & Fuel Policy

  • Vehicle must be returned in the same clean condition as provided.

    • A cleaning fee of up to 400 MAD will be charged for any dirt, stains, or interior neglect.

  • The fuel tank must be full upon return.

    • Refueling fee includes the actual cost of fuel + 20% service charge.

3.2 Timely Return

  • Vehicles must be returned by the agreed time and to the specified drop-off location.

  • Penalty for Late Return or Abandonment:

    • If a vehicle is returned late without prior notice, or abandoned at any unauthorized location, the Renter will be charged 20% of the full rental amount.

    • Repeated late returns may result in rental restrictions or bans.


4. Special Delivery Requests

  • Delivery or return of the vehicle to non-standard locations (e.g., airports, hotels, off-site addresses) must be requested and approved in advance.

  • A special handling fee will be applied based on distance and logistics (typically between 100–300 MAD within major cities).


5. Legal Disputes & Enforcement

  • This agreement is governed by the laws of the Kingdom of Morocco.

  • All disputes arising from this policy will be settled in the competent courts of Casablanca or the jurisdiction closest to our registered office.

  • Ramsco Car reserves the right to pursue full legal and financial remedies, including:

    • Legal action for non-payment.

    • Police reporting for abandoned vehicles.

    • Enforcement of unpaid damages through banking authorities and insurance.


6. Fraud & Misrepresentation Clause

  • Any false information provided by the Renter, including fake identities, forged cheques, false license details, or fraudulent claims, will result in immediate cancellation of the agreement, and be reported to local law enforcement authorities.

  • Cheques returned unpaid (for any reason) will be treated as criminal fraud, and Ramsco Car will pursue prosecution and damages under Moroccan commercial and penal law.


7. Agreement Acceptance

By proceeding with your rental, you agree to abide by all clauses of this policy and acknowledge that you have read and understood each term. We encourage open communication and fairness and are committed to delivering excellent service to clients who act in good faith.

8. Accidents & Insurance Impact

In the event that the rented vehicle is involved in an accident—whether the Renter is at fault or not—the Renter will be charged:

  • The set deductible amount (as per the rental contract or insurance agreement), plus an additional 20% penalty.

This surcharge reflects the increase in our insurance premiums as a result of the claim.

It applies regardless of whether the Renter used personal or third-party insurance, and must be paid in full before the return of the security deposit cheque.


9. Payments by Credit Card or PayPal

Ramsco Car Rental accepts credit card and PayPal as alternative payment methods for convenience. However, the following conditions apply:

9.1 Credit Card Payments

  • The 25% upfront cash deposit does not apply when paying entirely by credit card.

  • Full payment must be completed at the time of booking or before the vehicle is delivered.

  • All credit card transactions are subject to a 5% processing and service fee, which includes:

    • Merchant fees charged by banks and payment processors.

    • Applicable Moroccan VAT (TVA) in accordance with local tax laws.

  • In case of dispute, Ramsco Car reserves the right to provide all evidence (signed contracts, photos, timestamps) to the issuing bank.

9.2 PayPal Payments

  • A service fee of 7% will be applied to all PayPal payments due to international processing and conversion charges.

  • The Renter is responsible for covering the full amount after service fees and currency conversion, so the rental total reflects the base amount agreed in Moroccan Dirhams (MAD).

  • Security deposits cannot be held via PayPal. Clients using PayPal must still provide a valid Moroccan cheque or cash deposit for the damage guarantee.

9.3 Fraud Protection & Refund Disputes

  • Any attempt to dispute or reverse payments fraudulently after using our services will be reported as commercial fraud and pursued under Moroccan Penal and Commercial Codes.

  • Ramsco Car reserves the right to charge additional administrative fees for handling chargebacks, including legal and bank processing costs.


10. Post-Return Inspection Period

Upon the return of the vehicle, Ramsco Car Rental reserves a grace period of 1 to 7 business days to conduct a comprehensive inspection. This period allows us to verify that:

  • No parts have been damaged or replaced without authorization.

  • All vehicle systems, including GPS and onboard cameras, are functioning as initially provided.

This inspection period applies to all payment methods, including Visa, cheques, credit cards, and PayPal. The security deposit will be refunded only after this inspection confirms the vehicle’s integrity.


11. Tampering with Vehicle Surveillance Systems

Ramsco Car Rental vehicles are equipped with GPS tracking and onboard cameras to ensure safety and compliance with rental agreements. The following actions are strictly prohibited:

  • Blocking, disabling, or tampering with the vehicle’s camera systems.

  • Interfering with or disabling the GPS tracking system.

Such actions are considered fraudulent and may lead to:

  • Immediate termination of the rental agreement.

  • Forfeiture of the security deposit.

  • Legal action in accordance with Moroccan laws.


12. Legal Framework for Fraudulent Activities

Ramsco Car Rental adheres strictly to Moroccan laws concerning fraudulent activities. Relevant legal provisions include:

  • Moroccan Penal Code Article 543: Addresses the issuance of cheques without sufficient funds, considering it a criminal offense.

  • Moroccan Commercial Code: Governs commercial transactions and penalizes fraudulent activities in business dealings.

Engaging in fraudulent activities, such as tampering with vehicle systems or issuing dishonored cheques, will result in legal action under these laws.
